10.2 Establishing Terms and Conditions


The primary focal point for personnel involved in market research is likely to be the establishment of the terms and conditions that are customarily used in commercial contracts for the items being acquired.

Customary commercial terms and conditions can vary significantly among various commodity groups. Evaluating commercial terms and conditions is a new activity for Government procurement personnel, and it is likely to be difficult. The number of possible alternatives to the wording of any particular term or condition is virtually limitless. Whatever the choice, the rationale for the decision must be documented.
